Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioner apprehend his arrest in connection with Buniyadganj P.S. Case No. 181 of 2021, registered for the offences punishable under Sections 323, 341, 504, 354, 379, 34 of the Indian Penal Code.

As per allegation, the informant was returning by bus after appearing in an examination. The petitioner was also a passenger of the bus. He started touching her person and on objection he abused her brother Anand Kumar and thereafter, son and nephew of the accused alongwith 4-5 unknown persons

Patna High Court CR. MISC. No.11683 of 2022(2) dt.17-09-2022 2/3 having pistol and danda stopped the bus. Thereafter, boarded in bus and assaulted the brother of the informant and the informant was also abused. The accused persons also snatched Rs. 12,000 from her purse.

Learned counsel for the petitioner has submitted that he is innocent. He has not named in the FIR and he is on the verge of retirement. The petitioner is a person of clean antecedent.

Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M, VIIIth, Gaya in connection with Buniyadganj P.S. Case No. 181 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C. The petitioner is directed to appear before the court below on each and every date till framing of the charge.

Learned court below shall verify the criminal antecedent of the petitioner and if it is found that he is accused in any other case his bail bond shall be cancelled.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
