JUSTICE BIRENDRA KUMAR ORAL ORDER 19-04-2017 Heard the learned counsel for the petitioner and the State.

This is a petition for grant of regular bail for offences under Sections 302, 201 and 120B of the Indian Penal Code.

According to first information report, co-accused, Bablu and others had taken deceased with them, thereafter, in the next morning the dead body was found. The witnesses, who claimed to be the eye witnesses of the occurrence, did not name the petitioners or co-accused, Bablu, as assailant or the persons present at the time of crime. Bablu has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No. 43787 of 2016.

Considering the aforesaid fact, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Lakhisarai P.S. Case No. 235 of 2016 to the satisfaction of the Chief Judicial Magistrate, Lakhisarai, or successor Court.
