2. The petitioners apprehend their arrest in a case registered for the offence under Sections 103, 61(2) & 3(5) of the Bhartiya Nyaya Sanhita.
3. The prosecution case, in brief, is that on 14.10.2024 at about 7 PM, while father of informant was returning from Kanti, 4-5 unknown miscreants surrounded and shot him. On hearing the sound of firing, nearby people reached there and miscreants fled away on motorcycle. Thereafter, father of
Patna High Court CR. MISC. No.11112 of 2025(2) dt.18-03-2025 2/3 informant was taken to hospital and in course of treatment, he died. Informant suspects that these petitioners, by hatching a conspiracy with some unknown miscreants, got her father killed due to some property dispute.
4. Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case due to property dispute. Informant is not eye-witness to the occurrence. As per F.I.R., it was unknown miscreants, who committed offence and petitioners are only alleged to be conspirator. There is no specific allegation of overt act against these petitioners. Petitioner no. 2 & 3 have got clean antecedent, whereas petitioner no. 1 is accused in one case, in which, he is on bail.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - 3rd (West), Muzaffarpur in connection with Kanti P.S. Case No. 549 of 2024, subject to
Patna High Court CR. MISC. No.11112 of 2025(2) dt.18-03-2025 3/3 condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
