JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 05-05-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
It is alleged that cash and mobile of the informant were robbed by two motorcycle borne criminals.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named in the F.I.R. There is general and omnibus allegation
Patna High Court CR. MISC. No.11485 of 2023(2) dt.05-05-2023 2/2 against the petitioner. Nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner is languishing in custody since 31.08.2022.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra, Saran in connection with Ekma P.S. Case No. 343 of 2022.
