Petitioner is accused in connection with Madhepura P.S. Case No. 909 of 2019 registered under Sections 420, 504 and 506 of the I.P.C.
Submission of learned counsel for the petitioner is that petitioner is ready to pay the total consideration amount of Rs. 6,95,000/-.
Today, learned counsel for the petitioner handed over a Bank Draft of Rs. 2,00,000/- in favour of the informant Sumit Kumar, xerox-copy of the said Bank Draft is annexed as Annexure-6 to the supplementary affidavit. He also undertakes that rest of the amount i.e. Rs. 4,95,000/- will be paid within
Patna High Court CR. MISC. No.11435 of 2020(2) dt.04-03-2020 2/2 two consecutive months in two equal installments. Further, he submits that on payment of total consideration amount, the informant may be asked to take steps for compromising the case.
Learned counsel for the informant has received the above Cheque and also agrees with the above submissions and ready to take steps for compromising the case after taking full payment.
Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Madhepura in connection with Madhepura P.S. Case No. 909 of 2019, subject to the payment of Rs. 4,95,000/- within two consecutive months in two equal installments. However, it is made clear that if the petitioner fails to pay the rest amount in terms of the aforesaid direction, the bail granted to the petitioner shall be cancelled automatically.
