JUSTICE SANJAY PRIYA ORAL ORDER 4/ 07-04-2017 Heard learned counsel for the Petitioner and the State.

The Petitioner apprehends his arrest in Kishanganj P.S. Case No.300 of 2016 instituted for the offence under Section(s) 419, 420, 467, 468, 471/34 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Kishanganj. It is alleged against this petitioner that he got appointment of Contract Teacher on the basis of mark-sheet and certificate of B.Ed. and on enquiry his degree of B.Ed. was found to be fake. It is further alleged that after getting employment on such fake certificate(s) he also received honorarium from the treasury of the Govt. of Bihar.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.10546 of 2017 (4) dt.07-04-2017 2/2 he has voluntarily submitted resignation.

In the facts and circumstances of the case, this Court does not find it a fit case for grant of anticipatory bail. Prayer is rejected.

The petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
