2. This application is for grant of regular bail in connection with Durgawati P.S. Case No.93 of 2023, registered for the offences under Sections 8(c), 21(c), 22, 27(A) and 29 of the NDPS Act. This is the third attempt of the petitioners for grant of regular bail before this Court.
3. As per the F.I.R., there is recovery of 510 gms of heroine from the petitioners.
4. Learned Senior Counsel for the petitioners submits that the trial of the petitioners has begun and the witnesses are
Patna High Court CR. MISC. No.13860 of 2025(3) dt.13-05-2025 2/3 being examined. The petitioners are in custody since 12.04.2023 and petitioner no.1 has no criminal antecedent and petitioner no.2 has one criminal antecedent
5. Considering the facts and circumstances of the case, this application is allowed.
6. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 3rd, Kaimur at Bhabua/concerned Court below, in connection with Durgawati P.S. Case No.93 of 2023.
7. The petitioners shall cooperate in the trial personally or through their counsel.
8. One of the bailor will be a blood relative of the petitioners, who will give an affidavit giving genealogy as to how he is related with the petitioners.
9. This is also subject to the condition that the petitioners shall mark their attendance at Karanda Police Station, Ghazipur, Uttar Pradesh on every Sunday of each month. Any default in appearance at the police station would result in the cancellation of bail bonds of the petitioners.
