JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case filed with accusation under Sections 406 and 420 of the Indian Penal Code.

It is alleged by the complainant that the petitioner being police officer did not register Teghra P.S. Case No. 220 of 2011 with actual accusation rather the accusation was changed since the petitioner signed the written report in semi unconscious position. It is submitted by learned counsel for the petitioner that Teghra P.S. Case No. 219 of 2011 was registered against the complainant on the complaint of one Harihar Prasad whereas the

Patna High Court Cr.Misc. No.13384 of 2015 (2) dt.01-04-2015 2/2 complainant filed Teghra P.S. Case No. 220 of 2011. It is submitted by learned counsel for the complainant that during investigation also this fact has transpired that the petitioner interpolated the factual aspect of the accusation. Considering the nature of accusation ventilated through complaint, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Complaint Case No. 46C of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
