The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a) / 38 of Bihar Prohibition and Excise Act.

1387 liters of foreign liquor has been recovered from the house of co-accused Shiv Bhushan Singh.

It is submitted that nothing has been recovered from the conscious possession of the petitioner and petitioner has got no concern with the alleged recovery.

However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail and submitted that petitioner has got one criminal antecedent of similar nature. Considering the criminal antecedent of similar nature, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay/- U T
