JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in connection with Gaya Rail P.S. Case No.259 of 2016 registered under Sections 379 and 411 of the Indian Penal Code.

The accusation against the petitioner is that he was apprehended by the informant with the help of others at the railway platform Gaya, at the time of snatching the purse from the pocket of the informant.

Learned counsel for the petitioner submits that, in fact, the petitioner was present at the railway platform Gaya for boarding in the train but he was apprehended by the informant with the help of others under misunderstanding showing the

Patna High Court Cr.Misc. No.13518 of 2017 (2) dt.30-03-2017 2/2 recovery of a purse from the possession of the petitioner. petitioner has got no criminal antecedent and he is in custody since 13.09.2016.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C. J.M., Railway, Gaya, in connection with Gaya Rail P.S.Case No.259/16 subject to the condition that one of the bailers must be his close relative.
