Petitioner seeks bail in connection Bath P.S. Case no. 16 of 2019 registered for the offence punishable under sections 302, 201 of the Indian Penal Code read with section 27 of the Arms Act.

Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the FIR, it would manifest that on 08.04.2019 at 10 pm, her husband Sanjay Kumar Panjikar went to Asarganj from his native village on motorcycle bearing registration no. BR8F 6270 but he did not reach his house and his mobile was found switched off. Thereafter, it is alleged that the informant along with her Bhaisur asked to find whereabout of her husband and when they reached village Kastikry, they saw motorcycle there and dead

Patna High Court CR. MISC. No.21302 of 2021(2) dt.16-11-2021 2/2 body of her husband was thrown in a bush and on seeing the dead body, informant found that he was shot near his ear. Learned counsel for the petitioner submits that petitioner is not named in the FIR and his name has transpired in the confessional statement of co-accused. Further in para 12 of the petition, petitioner has specifically pleaded educational qualification and social service rendered by this petitioner (Annexure 2) and also he is person with clean antecedent and is in custody since 24.08.2020 and charge sheet has been submitted.

Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is a student aged about 21 years and he is in jail custody since 24.08.2020, not named in the FIR and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge IX, Bhagalpur in Sessions Trial no. 288/2020 arising out of Bath P.S. Case no. 16 of 2019.
