2. The petitioner seeks bail in connection with Bihar P.S. Case No. 279 of 2020 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 379 of the Indian Penal Code, subsequently Section 307 and 325 of the Indian Penal Code was added.
3. Prosecution case, in short, is that when the informant and his other associates were travelling to Dhobi Bigha, they were intercepted by the accused persons including the petitioner and were assaulted, robbed of valuables including pick-up van.
4. Learned counsel for the petitioner submitted that the
Patna High Court CR. MISC. No.12702 of 2025(2) dt.27-03-2025 2/3 petitioner has falsely been implicated in the present case. Learned counsel for the petitioner submitted that general and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. The only specific allegation against the petitioner is that he assaulted on the left hand of one Ajay Yadav and snatched Rs. 4,000/- from his pocket. Learned counsel further submitted that on perusal of the injury report, it appears that the allegation levelled against the petitioner is false and concocted. It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.10.2024 and has four criminal antecedents. The co-accused person has already been granted bail by a coordinate Bench of this Court vide order dated 29.03.2022 passed in Cr. Misc. No. 46611 of 2021.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case, claim based on parity as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of
Patna High Court CR. MISC. No.12702 of 2025(2) dt.27-03-2025 3/3 the like amount each to the satisfaction of Court below/concerned Court in connection with Bihar P.S. Case No. 279 of 2020.
