2. The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 323, 341 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, it is a case of assault upon the informant by means of lathi danda by the accused persons including the petitioner and also fired upon the informant which hit in the left side of the waist ear stomach. 4.

Learned counsel for the petitioner has submitted that petitioner has falsely been implicated in this case.

No.15341 of 2024(3) dt.19-04-2024 2/2 He next submits that all injuries are simple in nature so there is no case under Section 307 of the IPC and Section 27 of the Arms Act. He next submits that police has submitted chargesheet under sections 341, 323, 385, 307, 504 and 506 of the IPC and Section 27 of the Arms Act. Petitioner is in custody since 27.07.2022.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the aforesaid facts and circumstances of the case as well as period of custody of the petitioner, let the petitioner, above named, be directed to be released on bail in connection with Sessions Trial No. 17 of 2023 arising out of Barahiya P.S. Case No. 107 of 2020 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Lakhisarai.
