2. The petitioner is apprehending arrest in a case registered for the offences punishable in connection with Amba P.S. Case No.34 of 2020 under Sections 147, 149, 341, 323, 504, 307, 427, 436, 435, 447 and 448 of the Indian Penal Code.

3. As per the prosecution, the FIR has been lodged against 8 named accused persons including the petitioner against whom there is allegation of assault upon the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the petitioner has falsely been implicated in this case. He further submits that only being the gotiya, petitioner's name has been inserted in this case by the informant. He further submits that both informant and petitioner belong to the same village and they are well known to each other.

5. Counsel also submits that petitioner's antecedent is

Patna High Court CR. MISC. No.13657 of 2025(2) dt.28-03-2025 2/2 clean. He further submits that the other co-accused persons have been granted bail a Co-ordinate Bench of this Court vide order dated 24.11.2021 passed in Cr. Misc. No.5426 of 2021 and vide order dated 11.07.2022 passed in Cr. Misc. No.58783 of 2021.

6. Learned APP for the State opposes the prayer for bail.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, only on being satisfied by the trial court that the petitioner is not absconder, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Amba P.S. Case No.34 of 2020, subject to the following conditions as laid down under Section 438(2) of Cr.P.C.

8. It is made clear that if it has been found that the petitioner is a absconder, then in that case his bail bond shall be cancelled.
