JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 26-02-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Nawada Town Police Station Case No. 804 of 2015, disclosing offences under Section 392 of the Indian Penal Code.
Learned Counsel for the petitioner submits that one Amit Ranjan was, admittedly, apprehended by the police while committing the offence. The allegation is of snatching of a mobile from the informant. There were other persons also involved in the commission of offence. The said Amit Ranjan, in his statement made to the police, disclosed the name of this petitioner also as one of the
Patna High Court Cr.Misc. No.6251 of 2016 (2) dt.26-02-2016 2/3 persons involved in the commission of the offence. Learned Counsel for the petitioner submits that the co-accused, Amit Ranjan, disclosed the name of the petitioner out of animosity. He further submits that the petitioner has cleared XII Board examination with first division and is pursuing studies for entrance in technical institutions. He also submits that the main accused, Amit Ranjan, has been released on the ground of being a juvenile.
Considering the facts and circumstances, particularly, the submission that the petitioner is a student, this application is allowed.
Let the petitioner, Amar Kumar @ Amar Kumar Singh, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Nawada Town Police Station Case No. 804 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the same may be, as and when required and in the event
Patna High Court Cr.Misc. No.6251 of 2016 (2) dt.26-02-2016 3/3 of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
