The Petitioner seeks bail in Darbhanga/Sitamarhi G.R.P. Case No. 107 of 2016 instituted for the offence under Section(s) 370, 374/34 of the Indian Penal Code and Section 79 of the J.J. Act.
It is alleged that the police got free seven children from the clutches of this petitioner and one other accused on secret information that they are taking the children to Mumbai for getting the work as contract labour by Karambhumi Express. It has been submitted on behalf of the petitioner in para 7 of the bail petition that all the children recovered were family members of this petitioner and other co-accused. The
Patna High Court Cr.Misc. No.14603 of 2017 (2) dt.20-04-2017 2/2 Sarpanch and Mukhiya of the Gram Panchayat have also issued a certificate to that effect which has already been annexed as Annexure-3. It has further been submitted that similarly situated co-accused has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 5976 of 2017.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Railway Samastipur in connection with Darbhanga /Sitamarhi G.R.P. Case No. 107 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) Shageer/- U T
