2. The petitioner seeks regular bail in connection with Purushottampur P.S. Case No. 72/2023 registered for the offences under Sections 302, 201/34 of the Indian Penal Code.

3. The prosecution case in nutshell is that the coaccused namely Md. Allauddin had come to the door of the informant and had taken his son along with him. It has been stated that in the night a dead body was found to be lying on the railway track and the informant identified the dead body of his son Mazre Alam.

4. Learned counsel for the petitioner submits that petitioner is not named in the FIR and out of the two persons

Patna High Court CR. MISC. No.11589 of 2025(2) dt.06-05-2025 2/3 named in the FIR namely Md. Allauddin and Jahur Alam who had come to the house of the informant and had taken away the deceased, one person namely Jahur Alam has been granted bail by a Co-ordinate Bench of this Court vide order dated 29.01.2025 passed in Cr. Misc. No. 82908 of 2024. Learned counsel further submits that during the course of investigation the name of the petitioner has surfaced in the statement of one Raushan Ara and Gamgin Aalam. Learned counsel further submits that similarly situated co-accused person namely Shah Alam has also been granted bail by a Co-ordinate Bench of this Court vide order dated 04.04.2025 passed in Cr. Misc. No. 85907 of 2024. It is lastly submitted that the petitioner has two criminal antecedents and is languishing in custody since 21.06.2024.

5. Learned counsel for the State has opposed the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and taking into account that the petitioner is in judicial custody since 21.06.2024 and similarly situated coaccused person namely Shah Alam has been granted bail by a Co-ordinate Bench of this Court vide order dated 04.04.2025 passed in Cr. Misc. No. 85907 of 2024, let the petitioner above-

Patna High Court CR. MISC. No.11589 of 2025(2) dt.06-05-2025 3/3 named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Bettiah, District- West Champaran in connection with Purushottampur P.S. Case No. 72/2023.
