The petitioner is apprehending his arrest in connection with Sonbarsa Raj P.S. Case No. 133 of 2015 for the offences instituted under Sections 419, 420, 466, 467, 468, 471 and 120(B)/34 of the Indian Penal Code.
As per prosecution case one Tabbassum Naz, wife of Tabrez Alam @ Natho Ansari lodged a written complaint to the Officer-in-Charge, Sonbarsa stating therein that her land situated in Mauza Sonbarsa possessing Khata no.367, Khesara No.2049 and area 0.15 decimal is tried to be acquired by one Binod Singh. She stated that the land in question was purchased by her husband, Natho Ansarai from Ram Bahadur Babu and Madhusudan Babu
through registered deed vide no.4674, dated 19.04.1965 and it was mutated on 21.08.1992 vide Mutation Case No.90/92-93 and she has deposited rent upto 2015-16. She further stated that Jitendra Singh @ Putan Singh, this petitioner in connivance with the halka karmachari, Ramnath Prasad prepared a forged document of her aforesaid land for grabbing her land in question. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Petitioner's case is that the land in question is an ancestral land of one Binod Kumar Singh. Petitioner has got no concern with the said Binod Kumar Singh. It is also submitted that Binod Kumar Singh has also filed a mutation case no.1698/09-10. The other co-accused has been granted anticipatory bail by this Court vide Cr.Misc.No.50585 of 2015. The matter relates to civil dispute.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Sonbarsa Raj P.S. Case No. 133 of 2015 (GR No.2174 of 2015) on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like
amount each to the satisfaction of the learned CJM, Saharsa, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
