The petitioner apprehends his arrest in a case under Section 7 of the E.C. Act.

6.5 quintals of wheat and 1.75 quintals of rice were found in the godown of the petitioner Prahlad Sah. The petitioner is not a licensee of any PDS shop. It is submitted that the petitioner is an agriculturist. Nothing has come to show that the petitioner either purchased rice or wheat from any PDS dealer in order to sell the same in black-market nor any evidence has been collected to show that the petitioner has ever been found indulged in black-marketing of the controlled goods.

Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt
