The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 399, 402, 120B of the Indian Penal Code and Section 25 (1-B)a, 26, 35 of the Arms Act.
The prosecution case as lodged by the police personnel is that he got secret information that some miscreants are doing planning to commit robbery, he along with other police party proceeded at the spot whereafter seeing the police, accused persons tried to fled away but after chasing two persons were arrested and on search some mobiles and one motorcycle
Patna High Court CR. MISC. No.9944 of 2020(3) dt.24-06-2020 2/2 were recovered. Accordingly, seizure list was prepared. Learned counsel for the petitioner submits that he is innocent and has been falsely implicated in this case. He submits that neither any incriminating materials have been recovered from the possession of the petitioner nor he was found at the place of occurrence. He further submits that on the basis of confessional statement of co-accused his name has come in the present case.
Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, his payer for anticipatory bail is rejected in connection with Muffasil P.S. Case No. 287 of 2019 pending before the court of the learned A.C.J.M.-V, Samastipur. Accordingly, the application is dismissed.
