Learned counsel for the petitioners are expected to honour their undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioners are apprehending his/their arrest in connection with Nath Nagar (Lalmatia) P.S. Case No. 698 of 2020 for the offence registered under Sections 147, 148, 188, 353, 232, 509, 149, 269, 270 and 290 of the Indian Penal Code and Section 3 of the Epidemic disease Act and section 51 (B) N.D.M. Act.

The prosecution case in brief is that about 100 people armed with sword or bhala gathered for immersion of Kali statute. It is further alleged that when the police personal tried to pacify and stopped them to play the vulgar songs then the said persons became agitated and started to make noise and pelted stones. They also obstructed the police personal in discharging their duty.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in connection with the present case. There is general and omnibus allegation against the petitioners and nothing has been recovered from the conscious possession of the petitioners. It is further submitted

Considering the facts and circumstances of the case, let the petitioners, above named, in the event of his/their arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Nath Nagar (Lalmatia) P.S. Case No. 698 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Sunil Kumar Panwar, J) Jagdish/- U T
