2. The petitioner has moved before this Court seeking quashing of the order of suspension dated 29.01.1983, issued by the Bank of Baroda, under signature of Regional Manager, Muzaffarpur, whereby the petitioner has been placed under suspension on the charge of defalcation of Rs. 5,000/-.

3. Learned Advocate for the Bank of Baroda made preliminary objection and vehemently contended that writ petition is barred by delay and latches, inasmuch as, the petitioner has moved this Court after forty years.
