JUSTICE ARVIND SRIVASTAVA ORAL ORDER 04-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner is accused in connection with Barh P. S. Case No. 107 of 2016 registered for offences punishable under Sections 302, 120B/34 of the Indian Penal Code and under Section 27 of Arms Act.
The allegation upon the petitioner is of firing upon the deceased.
It has been submitted by the learned counsel for the petitioner that the petitioner has no criminal antecedent. Petitioner is in custody since 08.09. 2016. Charge sheet has already been submitted in the case.
However, learned A.P.P. for the State opposed the
Patna High Court Cr.Misc. No.4933 of 2017 (3) dt.04-04-2017 2/2 prayer of bail of the petitioner with submission that the petitioner is named in the F.I.R. and there is direction allegation of firing against him.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer for bail of the petitioner. Accordingly, this application is rejected (Arvind Srivastava, J) Sudha/- U T
