JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-04-2019 This is an application for grant of anticipatory bail in connection with Srinagar (Pujahan) P.S. Case No. 99 of 2017, disclosing offences under Sections 341, 323, 354, 354(C), 447, 376, 511, 504, 34 of the Indian Penal Code.
Allegation against the petitioner is that he entered into the house of the informant with bad intention and on Hulla, family members of the informant assembled and he was caught, but other co-accused persons came and get the petitioner flee and there is also allegation that he kept the liquor in the motorcycle of the brother-in-law of the informant. Submission of learned counsel for the petitioner is that as a matter of fact, petitioner and others had lodged a case against the informant and others with respect to illicit trade of liquor and for that he has been made accused in this case
Patna High Court CR. MISC. No.11682 of 2019(3) dt.29-04-2019 2/2 making false allegation after four days of alleged occurrence. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Srinagar (Pujahan) P.S. Case No. 99 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
