Petitioner seeks bail in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.
Allegation is that two persons snatched rupees twenty four thousand from the informant while she was returning back to her house after withdrawing the money from the bank. The snatchers were apprehended which includes the petitioner. However, from possession of the petitioner only one note of rupees two thousand was recovered besides the pass-book. Submission of the petitioner is that false allegation is there, otherwise the petitioner was apprehended on the spot, hence, entire snatched money should have been
Patna High Court Cr.Misc. No.18243 of 2017 (3) dt.17-05-2017 2/2 recovered. Petitioner has got no criminal antecedent and there is no other material in the case diary.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Chief Judicial Magistrate, Supaul/successor Court in connection with Chhatapur Police Station Case No. 383 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
