2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 30(a) of Bihar Prohibition and Excise Act in connection with Excise P.S. Case No.75 of 2020.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and allegation is of recovery of 05 liters of liquor from main road. It is next submitted that petitioner was not arrested from the spot as such nothing was recovered from his conscious possession.

4. The learned APP for the State opposes the anticipatory bail application.

5. Considering the fact that no recovery has been

No.10756 of 2026(2) dt.17-02-2026 2/2 made from the conscious physical possession of the petitioner and also taking into account that it has been recovered from an open space i.e main road and also given the fact that the petitioner has no criminal antecedent, this Court is inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge,VII-cumSpecial Judge, Excise-II, Madhepura in connection with Excise P.S. Case No.75 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C./Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.
