Mr.Ram Bilash Roy Raman ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2019 The petitioner apprehends his arrest in connection with Raxaul P.S.Case No. 211 of 2018 registered under Section 379 of the Indian penal Code.

Allegation as per FIR is of theft of a motorcycle. FIR is against unknown but later on, on co-accused has been arrested and on his confession, name of the petitioner transpires and it is alleged that co-accused has purchased the motorcycle from this petitioner.

Submission of learned counsel for the petitioner is that there is nothing available on the record to show that stolen motorcycle was purchased from the petitioner and he has no criminal antecedent.

Heard learned APP also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant

No.11339 of 2019(2) dt.25-02-2019 2/2 privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order, if possible, on the same day.
