2. This is the second attempt for bail of the petitioner as earlier such prayer was rejected by order dated 22.05.2023 in Cr. Misc. No. 60828 of 2022.

3. The petitioner seeks bail in connection with Benipatti P.S. Case No. 67 of 2021 registered for the offence under Sections 147 /148/ 149/ 341/ 323/ 324/ 325/ 326/ 307/ 302/ 120B of the Indian Penal Code.

4. The following order was passed on 22.05.2023 in Cr. Misc. No. 60828 of 2022 which reads as under: " Heard the learned counsel for the petitioner and learned counsel for the State. Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection

Patna High Court CR. MISC. No.15005 of 2024(3) dt.03-05-2024 2/2 with Benipatti P.S. Case No. 67 of 2021 registered for the offence under Sections 147/148/149/341/323/324/325/326/307/302/120B of the Indian Penal Code.

Mr. Yogesh Chandra Verma, learned senior counsel for the petitioner has vehemently argued that two similarly situated accused persons have been granted bail. In a case of five murders, the allegation against the petitioner is of killing one deceased and there is no specific allegation against the petitioner is of killing four other deceased.

In a case of five murders, this Court will not go into such niceties.

Learned APP has vehemently opposed the prayer of the petitioner for bail.

In view of the aforesaid, this application for regular bail is dismissed.

The trial Court is directed to conclude the trial at the earliest."

5. This Court finds no ground to review its earlier order dated 22.05.2023.
