JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-03-2020 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Govindpur P.S. Case No. 239 of 2018 for the offence under Section 30(a) of the Bihar Prohibition & Excise Amendment Act, 2016.

In the instant case total 20 litres of liquor as well as 10 litres beer was seized from the scooty.

Learned counsel for the petitioner submits that the liquor was seized from the scooty, which does not belong to the petitioner. He further submits that nothing was seized from the conscious possession of the petitioner.

Considering the fact that nothing was seized from the conscious possession of the petitioner, the petitioner named above, in the event of arrest or surrender before the court below

Patna High Court CR. MISC. No.11562 of 2020(2) dt.04-03-2020 2/2 within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise Act, Nawada in connection with Govindpur P.S. Case No. 239 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
