The petitioner seeks bail in Mehshi P.S. case No. 233 of 2016 under Section 414/34 of the Indian Penal Code. The informant got information that the accused persons had brought a Bolero jeep near Bahadurpur market for sale. The police reached the place but the accused persons fled away. On chase, one Dilip Kumar Rai, the petitioner, was apprehended. The petitioner disclosed that he committed theft of vehicle from Darbhanga and the vehicle is parked near the market for sale.
The learned counsel for the petitioner submits that petitioner is in custody since 24.12.2016 but the police has not
Patna High Court Cr.Misc. No.18765 of 2017 (3) dt.10-05-2017 2/2 been able to trace out the case of theft of the vehicle. The petitioner has remained in jail for more than four months. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, East Champaran at Motihari in Mehshi P.S. Case No. 233 of 2016.
