In this case, the petitioner is apprehending his arrest in connection with Khajouli P.S. Case No. 150 of 2018 (G.R. No. 1255 of 2018) registered for offences under sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per allegation, the police has recovered 30 liters of illegal Nepali liquor kept underground in the plastic bottle in the Mango orchard of another person.
Learned counsel for the petitioner submits that the Mango orchard does not belong to the present petitioner. Looking to the entire facts and circumstances of the case as also the quantity of liquor recovered, this Court is not inclined to grant privilege of anticipatory bail.
Patna High Court CR. MISC. No.12931 of 2019(2) dt.06-03-2019 2/2 Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.
