JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 11-04-2019 The petitioner seeks regularization of his service on the post of Driver in the Town Panchayat, Nirmali, for the reason that he has spent about 11 years as a daily-wager and has rendered his services to the satisfaction of all concerned.

2. The petitioner is candid enough to state in the

Patna High Court CWJC No.5669 of 2019 dt.11-04-2019 2/3 petition that despite the length of period for which he has served the Department/Organization, he cannot claim, as a matter of right, regularization in service; nonetheless, he has approached this Court only for invoking the good conscience of the Organization for which a direction is sought for from this Court.

Without commenting upon the right of the petitioner for being regularized in service on which he has been working for the last 11 years, the petitioner is given a liberty to make a fresh representation before the Executive Officer, Town Panchayat, Nirmali, District-Supaul (respondent No. 4) within a period of four weeks from today, who, on receipt of such representation and after verifying the facts, viz., whether any person, similarly situated, has been regularized in service or whether the petitioner ought to be given the same privilege, shall pass necessary order in accordance with law, without being at all influenced by the fact that the present petition has been disposed off with a liberty to the petitioner to make such representation, within a further period of six weeks thereafter.
