JUSTICE BIRENDRA KUMAR ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 25(1-B)a/26 of the Arms Act. From the house of this petitioner a pistol was allegedly recovered. On examination of the same it was found ineffective one.
Submission of the petitioner is that recovery was not made from the conscious possession of the petitioner. The house is occupied by some other family members. Moreover, there is no reason to keep ineffective fire-arm. Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.13289 of 2017 (2) dt.22-03-2017 2/2 Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Mr. Vikash Jha, learned Judicial Magistrate, 1st Class, Madhubani/Successor Court, in connection with Raj Nagar P.S. Case No.13 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
