Since both these applications arise out of Kajra P.S. Case No. 98 of 2020, they have been heard together and are
Patna High Court CR. MISC. No.21291 of 2021(5) dt.02-02-2022 2/3 being disposed of by this common order.
The petitioners of both these applications apprehend their arrest in connection Kajra P.S. Case No. 98 of 2020 registered for the offences under Sections 121 and 120(B) of the Indian Penal Code; Sections 25(1-AA), 26(i)(ii) and 35 of the Arms Act; Sections 3/4 of the Explosive Substances Act; and Sections 16, 17, 18 and 20 of the Unlawful Activities (Prevention) Act.
Considering the fact that the petitioners have criminal antecedents and they are involved in Naxal activities and there are sufficient materials against them which have been given in the counter affidavit filed by the State, I am not inclined to grant anticipatory bail to them. Both these applications for anticipatory bail is dismissed.
Petitioners of both these applications are directed to surrender in the court below within two weeks from today. If the petitioners do not surrender in the court below within the next two weeks from today, the Superintendent of Police, Lakhisarai will take all steps to arrest them. Let a copy of this order be communicated to the Superintendent of Police, Lakhisarai through FAX for its compliance immediately.
