JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-02-2020 The petitioner seeks bail in connection with Rajoun P.S. Case No. 457 of 2019, dated 04.11.2019, instituted for the offences under Sections 323, 341, 307, 504, 506 and 34 of the Indian Penal Code.

The petitioner is in custody since 30.11.2019. The petitioner and his wife are alleged to have assaulted the informant and made attempts to drag the wife of the informant inside his house. According to the F.I.R., the genesis of the occurrence is an earlier dispute, when the petitioner is said to have entered into house of the informant in an inebriated condition and when he was about to be

There appears to be some dispute in the past. Though the injury suffered by the informant is said to have been caused by hard and blunt substance, but the opinion regarding the nature of injury has been kept reserved. However, regard being had to the period of custody of the petitioner which is from 30.11.2019 and the fact that the petitioner does not have criminal antecedents, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No. 457 of 2019.

The application stands allowed.
