Heard learned counsel for the petitioner and learned A.P.P. for the State.

Learned counsel for the petitioner submits that the petitioner along with Milan Kumar and 4 others had moved this Court seeking anticipatory bail by filing Cr. Misc No. 61774 of 2024 and the same was allowed by an order dated 28-8-2024 but then it appears that while granting the privilege of anticipatory bail to all the accused petitioners, the name of petitioner No. 5 was inadvertently not recorded in the order dated 28-8-2024. It is submitted that all the five petitioners were granted the privilege of anticipatory bail in Cr. Misc No. 61774 of 2024 but then on account of bonafide inadvertence at the time of typing of the bail order, it appears that the name of the petitioner No. 5, i.e., Shivshankar Yadav was inadvertently omitted. It is thus submitted that the instant modification application has been filed

Patna High Court CR. MISC. No.13216 of 2025(2) dt.05-03-2025 2/2 seeking modification of the order dated 28-8-2024 in Cr. Misc No. 61774 of 2024 with a prayer that the name of petitioner No. 5 (Shivshankar Yadav) be also added in the order dated 28-82024 in Cr. Misc No. 61774 of 2024. 3.

The learned APP also does not oppose the modification application.

Considering the submission made by the learned counsel appearing on behalf of the petitioner, the order 28-82024 is modified to include the name of petitioner No. 5 also, i.e. Shivshankar Yadav (petitioner herein).

The modification application is allowed.

It is made clear that if the petitioner surrenders on or before 29-3-2025, his bail bond shall be accepted on furnishing bail bonds of Rs. 5,000/- (Five Thousand) with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Govindaganj P.S. Case No. 233 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Satyavrat Verma, J) SUMIT/- U T
