JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-03-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Bhabhua (Sonhan) P.S. Case No. 723 of 2019 for offences under Sections 341, 323, 307, 354 and 506/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. Learned counsel submits that there is case and counter case on account of the land dispute between the parties. Learned counsel further submits that specific allegation of assault on the head of the informant is against co-accused Mahendra Kahar, who is not one of the petitioners in this case.

Let petitioners, above-named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Bhabhua (Sonhan) P.S.
