JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-05-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,323,337,338,307,333,216A,224,225,341,342,353,427 ,379 and 504 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that when the police went to apprehend Rajesh Yadav, an accused of Nawada (Kadirganj) P.S. Case No. 43 of 2013 and subsequently apprehended him but in the meantime, the mob forcibly got him released, pelted stones and assaulted the police personnel when Mukesh Yadav, Nithish Yadav, Rajesh Yadav and Nitin Yadav tried to snatch the service

Patna High Court Cr.Misc. No.13584 of 2015 (2) dt.07-05-2015 2/2 revolver of SI Jai Prakash Sharma then the police resorted to firing.

It is submitted by the learned counsel for the petitioners that in the scuffle the son of petitioner no. 1 was killed for which Nawada Town P.S. Case No. 143 of 2014 was lodged and in order to save the skin the police lodged the present case. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Nawada in connection with Nawada (Kadirganj) P.S. Case No. 144 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
