The petitioner being the mother of the husband of the victim is apprehending her arrest in a case registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code.
Accusation is of killing the niece of the informant after two and half years of marriage for non-fulfillment of dowry demand.
It is submitted by the learned counsel for the petitioner that accusation is not specific against the petitioner. Moreover, the demand of dowry was of Alto Car and gold chain, which obviously was not for the petitioner, who is an old lady. Considering the thrust of accusation against the
Patna High Court Cr.Misc. No.15697 of 2015 (2) dt.05-05-2015 husband of the victim, who as per the counsel for the petitioner, is in custody, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Sangrampur P.S. Case No. 79 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
