This is an application for bail in connection with Sohail P.S.Case No. 7 of 2016 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. It has been submitted on behalf of the petitioners that petitioners have falsely been implicated due to family dispute. It has further been submitted that petitioner No.2 is a lady having two children in her lap and on that ground she may be granted bail.

Heard learned APP also, who has opposed the prayer for bail stating that in the FIR there is direct allegation against the petitioners of assault and putting the deceased in the well and the complicity of the petitioners has been supported by the witnesses

Patna High Court Cr.Misc. No.10555 of 2017 (3) dt.04-04-2017 2/2 in course of investigation.

Having heard both sides and considering the facts and circumstances of the case, as stated above, I am not inclined to grant bail to the petitioners.

However, as the petitioners are in custody, learned trial court is directed to expedite the trial. Accordingly, this application is dismissed.
