This application for anticipatory bail, arises out of Sonepur Police Station Case No. 1009 of 2018, disclosing offences punishable under Sections 384 and 387/34 of the Indian Penal Code.

The accused persons are said to have asked the informant's father to execute a sale deed in their favour in respect of certain piece of land and when the informant's father

Patna High Court CR. MISC. No.12671 of 2019(2) dt.01-03-2019 2/2 refused to yield to such demand, they allegedly demanded extortion money. There is no allegation of assault. On perusal of the First Information Report, I find, prima facie, some degree of absurdity in the case of prosecution. In view of the above submission, this application is allowed.

Let the petitioners, above-named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-X, Saran at Chapra in connection with Sonepur Police Station Case No. 1009 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
