The petitioner seeks bail in D.R.I. (N.D.P.S.) Case No. 02/16-17 registered under Sections 20, 25 and 19 of the NDPS Act.

Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application taking into account that 400.39 kg. Ganja was recovered and as per Section-37 of the NDPS Act, the petitioner was not entitled for bail. A report was called for from the trial court. It has been reported that out of 8 prosecution witnesses, five prosecution witnesses have already been examined.

Considering the nature of allegation and stage of the case,

Patna High Court CR. MISC. No.21764 of 2021(3) dt.08-09-2021 2/2 I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner is rejected. Learned trial court is directed to take necessary steps to conclude the trial as early as possible preferably within a period of nine months from the date of receipt/production of copy of this order.
