JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-10-2024 The present writ petition has been filed seeking the following reliefs:- "1. (i) For issuance of a writ in the nature of Mandamus, seeking a direction upon the Respondent No.3, i.e. the District Magistrate to stop construction work of newly proposed police building on the land of Hospital and further direct the respondents concerned to stop the demolition of the boundary and the Doctor's and Staff quarter.

(ii) For issuance of a writ in the nature of Mandamus, seeking direction to the respondents concerned to re-measure the land in question, where police

Patna High Court CWJC No.4541 of 2020 (3) dt.17-10-2024 2/2 building is being constructed, in presence of both the parties because as per Khatiyan, the empty (vacant) land is only 40 decimals, which is shown in the Khatiyan as "Hata", but the respondents are encroaching the land of the Hospital, which though is about 30 decimals, however, the same will cause difficulty in modifying the Hospital building in future."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Secretary, Health Department, Government of Bihar, Patna for redressal of his aforesaid grievances. Liberty so sought is granted. 3.

The writ petition stands disposed off.
