2. The petitioner apprehends his arrest in connection with Gaurichak P.S. Case No. 430 of 2025, instituted for the offences under Sections 316(2), 318(4), 324(4), 351(2), 3(5) of the B.N.S.
3. As per the prosecution case, informant entered into an agreement for sale with co-accused Krishna Kumar. Total consideration money of Rs. 76,50,000/- was paid to him. Coaccused Krishna Kumar although executed some sale-deed and he is not executing the sale-deed for the remaining land.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.11087 of 2026(3) dt.06-05-2026 2/2 petitioner is innocent and has falsely been implicated in this case. There is no single transaction made by the informant with the petitioner. Petitioner is neither landlord nor the executor of the agreement for sale. Petitioner has no concern either with the land in question or transaction with the informant and coaccused Krishna Kumar. Petitioner has no criminal antecedent. Petitioner undertakes to co-operate in the investigation and trial.
5. Learned A.P.P. for the State and learned counsel for the informant oppose the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case, submission of learned counsel for the parties and clean antecedent of the petitioner, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. II, Patna City in connection with Gaurichak P.S. Case No. 430 of 2025, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
