2. The petitioners apprehend their arrest in connection with Shambhuganj P.S. Case No. 339 of 2024 for the offence registered under sections 126(2), 115(2), 118(1), 117(2), 109, 303(2), 352, 351(2), 3(5) of B.N.S. lodged on 02.12.2024 by the informant, Surti Devi.
3. As per the prosecution story, the informant alleged that in the morning, the accused persons came armed variously and started indiscriminate assault against her husband as also
Patna High Court CR. MISC. No.11274 of 2025(3) dt.12-05-2025 2/2 the son while they were planting onion seed in their field. They used lathi and khanti to assault son and husband. This led to the FIR.
4. Learned counsel for the petitioners submit that there is delayed FIR without any explanation and all the persons have been rounded of in the process. A complaint has also been filed by the other side. He submits that though one of the injury is simple, the other is grievous.
5. Learned APP on the other hand has taken this Court to the injury report to show that there is fracture of tibia so far as Sikendra Yadav is concerned, the assault has also been shown against Kishor Yadav, his son.
6. Considering the submissions as also the allegation, the petitioners indiscriminately assaulted the son and husband of the lady while they were planting onion seed in the field, the injury clearly shows the indiscriminate assault, in that background, relief cannot be extended.
