This application for regular bail arises out of Khajauli P.S. Case No. 46 to 2017 disclosing offences punishable under Sections 341, 323, 324, 307, 427, 380, 448, 354, 34 of the Indian Penal Code and Sections 4/5, 3⁄4 of the Explosive Substance Act.

Learned counsel appearing on behalf of the petitioner has submitted that land dispute between the parties is the apparent reason behind lodging of the F.I.R. and for the same occurrence, a counter case has been registered. He has submitted that there is no specific allegation against this petitioner of having made such assault, which could have caused nature of injuries as alleged in the F.I.R.

Patna High Court CR. MISC. No.10360 of 2020(2) dt.29-02-2020 2/2 I find substance in submission made on behalf of the petitioner that cases of two accused persons namely Sajjan Yadav and Baleshwar Yadav are on the similar footing, who have been allowed regular bail by this Court by an order dated 10.08.2017, passed in Criminal Miscellaneous no. 36088 of 2017. The petitioner is in custody since 30.11.2019. Considering the facts and circumstances of this application, this application is allowed.

Let the petitioner above named be released on bail furnishing bail bond of Rs.10,000/-(Rupees Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. III, Madhubani, in connection with Khajauli P.S. Case No. 46 of 2017.
