JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-05-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with Chiksaura P.S. Case No. 14 of 2016, registered under Sections 148, 149, 302 and 147 of Indian Penal Code, pending in the Court of 1st Addl. Sessions Judge, Hilsa, Nalanda. The accusation is that 17 persons named in the F.I.R., including the petitioner, surrounded to brother of the informant. At that time, this petitioner shot fire at the brother of the informant causing injury at his head, whereas co-accused Ajay Singh caused injury through fire arm at stomach of the brother of the informant. In the meantime, Naresh Singh also fired at him, but it did not hit him then he assaulted with butt to his brother causing injury near the eye. Thereafter, brother of

Patna High Court Cr.Misc. No.20095 of 2017 (2) dt.11-05-2017 2/2 the informant rushed for treatment, but he was declared dead. Learned counsel appearing on behalf of the petitioner submits that petitioner is in custody since 05.02.2016.

Having considered the facts and circumstances of the case and allegation of making firing at the head of the brother of informant by this petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected.
