JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Srinagar Pujaha P.S. Case No. 11 of 2017, registered under Section 30(a) of the Bihar Excise Act, 2016.

The accusation is that both the petitioners were apprehended by the Police with the motorcycle bearing Reg. No. BR-22R-8589. On search, 120 bottles, each containing 200 ML kept in plastic bag recovered from the possession of the petitioners.

Learned counsel for the petitioners submits that, in fact, the petitioners have been apprehended by the Police mere

Patna High Court Cr.Misc. No.17604 of 2017 (3) dt.11-05-2017 2/2 on suspicion with the motorcycle, which is belonging to Vishwanath Prasad, son of Shambhu Prasad, Resident of villageShivrajpur, P.S. Nautan, District-West Champaran at Bettiah. Further submission is that petitioners have no criminal antecedent and they are in custody since 07.02.2017. Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran at Bettiah in connection with Srinagar Pujaha P.S. Case No.11 of 2017.
