This is an application for grant of anticipatory bail in connection with Shikarpur PS case no. 115 of 2019 registered for the offences punishable under Sections 147, 149, 341, 342, 188, 353, 504, 506 of Indian Penal Code.
The allegation is regarding the accused persons having obstructed the road as also had created a road jam by putting the dead body of the deceased on the road and only after the District Administration had intervened, the vehicles were allowed to ply on the road. It is stated that the road was blocked to pressurize the administration and police to take action to apprehend the culprit who had killed the deceased. The learned counsel for the petitioner has
Patna High Court CR. MISC. No.10021 of 2020(2) dt.03-03-2020 2/3 submitted that the petitioner is innocent, is having a clean antecedent and is having no complicity in the matter. It is further submitted that similarly situated co-accused persons have already been granted anticipatory bail by co-ordinate Benches of this Court vide order dated 23.01.2020, passed in Cr. Misc. no. 87110 of 2019 and the order dated 24.01.2020, passed in Cr. Misc. no. 86518 of 2019.
Having regard to the facts and circumstances of the case, considering submissions made by the learned counsel for the petitioner as also taking into account the parity of the case of the petitioner with those co-accused persons who have already been granted anticipatory bail by co-ordinate Benches of this Court, I deem it fit and appropriate to admit the petitioner to the privilege of anticipatory bail. Accordingly, the abovenamed petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Shikarpur PS case no. 115 of 2019 subject to
