The petitioners have challenged the order dated 11.08.2014 passed by learned Chief Judicial Magistrate, Gaya in connection with Kotwali P.S. Case No. 155 of 2012 whereby cognizance has been taken for the offences under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code. Without adverting to the merits of the case, learned Advocate for the petitioners had informed this Court that after framing of charges, the trial has proceeded and the two
Patna High Court CR. MISC. No.15082 of 2015(6) dt.22-11-2019 2/2 witnesses have been examined.
Considering this aspect of the matter, this Court does not consider it appropriate to entertain this petition. The petition is dismissed with a liberty to the petitioner to contest in the trial.
